General Terms and Conditions

Article 1 – Definitions

1.1 Wedding Videographer: Adriano S, the contractor responsible for capturing the wedding day on video.
1.2 Client: The party commissioning the wedding videographer to record the wedding day on video.
1.3 Agreement: The written or verbal agreement between the wedding videographer and the client, outlining the provision of video services.
1.4 Video: The audiovisual recording of the wedding day, including all related footage, editing, and post-production.

Article 2 – Applicability

2.1 These general terms and conditions apply to all agreements between the wedding videographer and the client, unless otherwise agreed upon in writing.
2.2 By entering into the agreement, the client agrees to these general terms and conditions.

Article 3 – Services and Delivery

3.1 The wedding videographer will record the wedding day on the agreed date and time, in accordance with the specifications described in the agreement.
3.2 Delivery of the final video will take place within the agreed timeframe, generally within 4 to 12 weeks after the wedding day, depending on the selected video services.
3.3 The client will receive the video in an agreed format, such as a digital download link, USB stick, or another medium.
3.4 The wedding videographer reserves the right to edit and revise the footage as necessary, while maintaining the expected final result as discussed in the agreement.

Article 4 – Payment

4.1 The price for the services is agreed upon in advance and documented in the agreement.
4.2 A deposit of at least 30% of the total amount is required upon signing the agreement. An additional 30% must be paid no later than 7 days before the wedding day. The remaining 40% must be paid before delivery of the final wedding video.
4.3 If the outstanding balance is not paid on time, the wedding videographer reserves the right to withhold services.

Article 5 – Cancellation and Modification

5.1 The client may cancel the agreement at any time. The following cancellation fees apply:

  • Up to 3 months before the wedding day: 25% of the total amount

  • Between 3 months and 1 month before the wedding day: 50% of the total amount

  • Less than 1 month before the wedding day: 100% of the total amount

5.2 Changes to the agreement, such as date, location, or specific requests, must be communicated in writing and may incur additional costs.

Article 6 – Liability

6.1 The wedding videographer is not liable for damages resulting from unforeseen circumstances, such as equipment failure, bad weather, or other events beyond their control.
6.2 The wedding videographer is not responsible for the quality of the video resulting from technical issues due to the location or circumstances on the wedding day (e.g., poor lighting or noise).
6.3 The client is responsible for obtaining any necessary permissions for filming at the location (such as churches, wedding venues, or public spaces).

Article 7 – Intellectual Property and Rights

7.1 The wedding videographer retains the copyright to all recordings made during the wedding day.
7.2 The client receives a non-exclusive right to use the video for personal purposes and to share it with friends and family. The client is not permitted to use the video for commercial purposes without prior written consent from the wedding videographer.
7.3 The wedding videographer has the right to use footage from the wedding day for promotional purposes, such as on their website, social media, or in portfolios, unless otherwise agreed upon.

Article 8 – Confidentiality and Privacy

8.1 The wedding videographer will treat all personal data of the client as confidential and will process it in accordance with applicable privacy laws (such as the General Data Protection Regulation – GDPR).
8.2 The client declares that they have obtained consent from all guests present on the wedding day to be filmed, or will obtain this consent themselves.

Article 9 – Force Majeure

9.1 In the event of force majeure (such as illness, natural disasters, accidents, pandemics, etc.), the wedding videographer is not liable for failure to deliver the agreed services on time or at all.
9.2 If the wedding videographer is unable to record the wedding day on the agreed date, an alternative date or replacement videographer will be offered in consultation with the client.

Article 10 – Applicable Law and Disputes

10.1 Dutch law applies to this agreement.
10.2 All disputes arising from the agreement shall first be resolved through mutual consultation. If no resolution is reached, the dispute will be submitted to the competent court in the district where the wedding videographer is located.
